Terms of Service

Agreement

These Terms of Service ("Terms") govern your access to zentpak.com, ZentPak design tools, sample storefront, and related B2B packaging services ("Services"). By using the Services, you agree to these Terms.

If you are using the Services on behalf of a company, you represent that you have authority to bind that company.

Services

ZentPak provides custom packaging design tools, product information, sample ordering, and quote workflows for food, beverage, beauty, and retail brands. Production terms, pricing, MOQ, lead times, and specifications are confirmed in written quotes or purchase orders—not by website estimates alone.

Accounts

Some features may require an account. You are responsible for safeguarding credentials and for activity under your account. Notify us immediately of unauthorized use.

Acceptable Use

You agree not to:

• Use the Services for unlawful, fraudulent, or abusive purposes
• Upload content that infringes intellectual property or privacy rights
• Attempt to disrupt, scrape, reverse engineer, or bypass security controls
• Misrepresent your identity, company, or order intent

Enforcement and Consequences

Violation of these Terms may result in:

1. First violation: Written warning and content removal
2. Repeated violations: Temporary suspension of account (7-30 days)
3. Severe violations: Permanent account termination without refund
4. Illegal activity: Report to law enforcement and pursuit of legal remedies

We reserve the right to:

• Suspend or terminate access immediately for serious violations (fraud, illegal content, security threats)
• Refuse service or cancel orders at our discretion
• Seek damages and legal costs for violations that cause harm to ZentPak or third parties

You will be notified via email before suspension or termination unless immediate action is required for security or legal reasons.

Designs, Artwork, and IP

You retain ownership of artwork and brand assets you upload. You grant ZentPak a limited license to use submitted materials to provide quotes, proofs, samples, and production.

AI-generated previews are for planning purposes. Final print-ready files and color accuracy require approved proofs before production.

ZentPak retains ownership of its website, tools, templates, documentation, and proprietary manufacturing know-how.

AI-Generated Content Policy

ZentPak's AI packaging design tools (including AI Coffee Bag Designer and similar tools) are powered by DeepSeek Chat models via OpenAI-compatible API. These tools are provided to assist with design ideation and must be used responsibly.

Prohibited Content

You must not use our AI tools to generate, upload, or attempt to create:

1. Sexual or NSFW Content: Pornography, explicit sexual content, or sexually suggestive imagery
2. Violence and Gore: Graphic violence, blood, gore, or content depicting harm
3. Hate Speech and Discrimination: Content promoting hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
4. Child Safety Violations: Any content involving minors in unsafe, inappropriate, or sexual contexts (CSAM)
5. Deepfakes and Impersonation: Fake imagery or content impersonating real individuals without consent
6. Intellectual Property Infringement: Copyrighted designs, logos, trademarks, or brand assets you do not own or have permission to use

Content Moderation and Enforcement

Automated Filtering:

• AI-generated outputs are subject to automated content filtering before display
• Prompts containing prohibited keywords or patterns will be rejected

User Reporting:

• To report inappropriate content: abuse@zentpak.com
• Include screenshot, tool URL, and description of violation
• We review all reports within 48 hours

Platform Review:

• ZentPak conducts periodic audits of AI-generated content
• Suspicious patterns trigger manual review

Enforcement Actions

You acknowledge that:

• AI-generated content is your responsibility
• ZentPak is not liable for misuse of AI tools
• We cooperate with law enforcement for illegal content

AI Model Disclosure

Our AI design tools currently use:

• Primary Model: DeepSeek Chat (deepseek-chat via OpenAI-compatible API)
• Image Generation: (when applicable) Replicate API with Stable Diffusion models

Model versions may be updated without notice. The latest model information is available at: zentpak.com/about#ai-models

Orders, Samples, and Payment

Sample and production orders are subject to availability, artwork approval, and confirmed pricing. Payments processed through Shopify or other designated checkout providers are also subject to their terms.

Sample fees validate fit and quality; they are not a guarantee of future production pricing unless stated in writing.

Refund and Cancellation Policy

Standard Products and Samples:

• Non-customized sample orders may be cancelled within 24 hours of purchase for a full refund.
• After production has begun, sample orders are non-refundable.
• Damaged or defective items will be replaced at no charge if reported within 7 days of delivery.

Custom Production Orders:

• Once artwork is approved and production begins, custom orders cannot be cancelled or refunded.
• Orders may be cancelled before production begins, subject to a 15% processing fee.
• Design work and approved proofs are non-refundable.

Refund Processing:

• Approved refunds will be processed within 5-7 business days to the original payment method.
• Shipping fees are non-refundable unless the error was caused by ZentPak.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." ZENTPAK DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Website calculators, AI outputs, and marketing copy are estimates only.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENTPAK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID ZENTPAK IN THE 12 MONTHS BEFORE THE CLAIM.

Indemnity

You agree to indemnify ZentPak against claims arising from your content, misuse of the Services, or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction.

Changes

We may update these Terms. Continued use after changes become effective constitutes acceptance.
